TERMS AND CONDITIONS
These Terms and Conditions are binding upon the renter when renting any equipment from Rockstar Party Hire.
The care and security of all items rented is the responsibility of the person in charge of the event, and the person who has signed/accepted this agreement.
Party lights, bubble and fog machines, and any other party accessory are only available for rent when packaged with the Party Cube.
The price includes Free delivery and setup within a 15 km radius of our office in Lower Plenty. Other areas may incur a delivery surcharge. This is at the sole discretion of Rock Star Party Hire. Delivery time may vary and is based on good traffic conditions. $50 surcharge for bookings on new years eve, and only one promotional code may be used per hire.
Renter to provide on site delivery access. Unloading area should be flat unobstructed without stairs. Let us know if you have any special delivery requirements.
The Renter shall supply a correctly installed 10 Amp power outlet with earth and protected with a safety switch. Rockstar Party Hire will accept no liability for electrocution due to a faulty power supply.
After set up our staff member will demonstrate the operation and review the condition of all equipment rented with the person in charge. Any destruction or damage caused by the renter will be the renter's responsibility for repair or replacement. When renting any equipment from Rockstar Party Hire you are giving us permission to charge any outstanding funds owing for rental, repair, replacement of items damaged, stolen, withheld, or not returned in the same condition as supplied.
Equipment not returned on time and in accordance with this agreement will be subject to a continuance of the agreed rental until the return is complete.
To the extent permitted by law Rockstar Party Hire disclaims all liability for and does not give any warranties to the renter as to the condition of the equipment. The rental period is completed when the equipment has been returned to or collected by Rockstar Party Hire in the same condition as when it was delivered as outlined in the Rental Agreement.
Rockstar Party Hire will arrange to pick-up the equipment within a reasonable period after a request to do so. The Renter agrees to maintain the responsibility for the equipment whilst it is awaiting pick-up. If the Renter breaches any term, becomes bankrupt (individual) or insolvent (corporation) then Rockstar Party Hire may, without prejudice to any other remedy available to it: require immediate payment of all monies owed by the Renter to Rockstar Party Hire; charge the customer interest on any sum due at the prevailing rate pursuant to the Penalty Interest Rates Act 1983 (Vic) until the date of payment in full; charge the Renter for all costs and expenses (including without limitation all legal costs and expenses) incurred by Rockstar Party Hire by enforcing compliance with the terms or recovering the goods; charge the Renter for the cost of repairing or replacing any lost, damaged or destroyed goods; charge the Renter for subsequent lost hire charges as a result of the goods being lost, damaged or destroyed until the goods are repaired or replaced; and claim damages from Renter for breach of the Rental Contract.
Any persons or organizations renting equipment from Rockstar Party Hire are responsible / liable for any damage or injuries occurring from or as a result of misuse or reckless use. Persons using (Rockstar Party Hire) equipment do so at their own risk. Rockstar Party Hire cannot accept responsibility for any damage or injury to anyone using the equipment however caused. The responsibility for loss or damage of the equipment lies with the Renter. If the rented equipment is damaged, destroyed or confiscated due to irresponsible behaviour or otherwise, the Renter will be liable for the cost of repair or replacement as well as costs associated with the loss of income due to the unavailability of the equipment. Rockstar Party Hire is not responsible for any inconvenience, damage or injury sustained when using equipment rented from us.
Cancelation and Refund Policy
The Renter may cancel the booking at any time if more than (7) days notice is given without loss or penalty however, if the booking is cancelled within (7) days of your function Rockstar Party Hire will allow you to reschedule your event or pay a $50.00 cancellation fee. We do not give refunds after your function has finished. All issues are to be resolved at the time they occur.
If there is a breakdown or failure of the equipment the renter must notify Rockstar Party Hire immediately for the appropriate remedial action to be taken.
Renters Responsibility
The care and security of all items rented is the responsibility of the person in charge of the event, and the person who has signed/accepted this agreement.
The Renter will assume all risks and liabilities for, and in respect of, the equipment rented and for all injuries to or deaths of persons and any damage to property howsoever arising from the Renter’s possession, use, maintenance, repair, storage or transport of the equipment.The Renter agrees to ensure that any site specified on the rental agreement will be clear of all obstructions to allow Rockstar Party Hire to erect, install or place the equipment in position. Any items or objects that are required, or requested by the Renter, to be moved, are done so without any liability to Rockstar Party Hire. Rockstar Party Hire accepts no liability to loss or financial penalty, if due to adverse weather conditions, equipment installation or collection.
The Renter will assume all risks, damages and liabilities including, Water, Heat, Ice, Smoke, Sound Vibrations, Slips, Trips, Falls or Stains.
Liability to Third Parties: Rockstar Party Hire will not be liable for any claim for personal injury, death, loss or damage to property howsoever caused unless it is proved that such injury was caused by faulty equipment or negligence on the part of the Company.
Rockstar Party Hire shall not be responsible for any failure in the performance of any of its obligations under the Agreement caused by factors outside of its control, including but not restricted to, trade disputes, fire, act of God, war, civil emergencies, failure, breakdown or restrictions on the use of transport, fuel or power.
If through circumstances beyond the control of Rockstar Party Hire, Rockstar Party Hire is unable to provide the equipment as agreed, then Rockstar Party Hire may make changes to the equipment provided; or cancel any order.
